Curacao Vacation Management 
Terms and Conditions 
Accommodations

Effective Date: 27. October 2024

Welcome to Curacao Vacation Management! These Terms and Conditions ("Agreement") outline the rules and regulations for renting properties (houses, villas, apartments) managed by Curacao Vacation Management ("Company", "we", "us", "our"). By booking and staying in one of our properties, you ("Tenant", "you", "your") agree to comply with these terms. Please read them carefully. 

1. Booking and Payment Terms

1.1 Reservation Process

・To secure a reservation, a non-refundable deposit of $300 is required at the time of booking.
・The remaining balance must be paid no later than 6 weeks before the check-in date.
・Reservations made within ... days of the check-in date require full payment at the time booking.

1.2 Payment methods
・The deposit has to be paid via bank transfer.
・The outstanding amount for your booked accommodation can be paid in cash on arrival or
    also via bank transfer.
・All payments must be made in USD or ANG (local currency).

1.3 Cancellation Policy
・Deposit will be retained for cancellations more than 6 weeks prior to the trip.
・If the cancellation is made less than 6 weeks to one day of the arrival, 50% of the 
    accommodation costs will be refunded.
・If the cancellation is made on the day of arrival, no accommodation costs will be  
    reimbursed.


2. Security Deposit

2.1 Deposit Requirement 
・A refundable security deposit of $300 is required to cover any potential damages, excessive
    cleaning, or to cover water and electricity costs.
・The security deposit has to be paid in USD or ANG in cash at check-in.

2.2 Refund Process
・The security deposit will be refunded at check-out in cash. Provided there is no damage, 
    excessive cleaning, or missing inventory.
・If damages exceeded the security deposit, the Tenant agrees to cover the additional costs.


3. Check-In and Check-Out

3.1 Check-In
・Check-in time is from 3pm-10pm on the day of arrival. Early check-in may be possible upon 
    request and availability.

3.2 Check-Out
・Check-out time from 8am-10am on the day of departure. A late checkout for $45 can be 
    requested in advance, depending on availability of the accommodation.
・The property must be left in a clean and orderly condition. Failure to do so may result in
    additional cleaning fees.

4. Property Use and Conduct
​
​4.1 Occupancy Limits
・Check the occupancy number for each property. Exceeding this limit is prohibited and may 
    result in eviction without refund.

4.2 Parties and Events
・Parties, events or large gatherings are not allowed unless expressly permitted by Curacao 
    Vacation Management in writing.
・Violation of this rule may result in immediate eviction and forfeiture of the security deposit.

4.3 Noise and Nuisance 
・Tenants must respect the peace and quiet of the neighborhood. Excessive noise, loud music,
    or disruptive behavior will not be tolerated. 
・Quiet hours are from 10pm to 7am.

4.4 Pets
・Pets are only allowed in properties designated as "pet-friendly". 
・Tenants are responsible for cleaning up after their pets and ensuring they do not cause any
    damage or disturbance.

4.5 Smoking
・Smoking is strictly prohibited inside all properties. Smoking is only allowed in outdoor areas. 
・Failure to comply with the smoking policy will result in additional cleaning fees and potential
    forfeiture of the security deposit.


5. Maintenance and Repairs

5.1 Property Condition
・All properties are thoroughly inspected before check-in to ensure they are in good condition.
    Any pre-existing damage or issues should be reported to us within 24 hours of arrival.

5.2 Repairs
・Tenants must promptly report any maintenance issues or damages that occur during their 
    stay. 
・Emergency repairs will be addressed as soon as possible. Non-emergency repairs will be 
    scheduled during normal business hours. 


6. Liability and Insurance 

6.1 Tenant Responsibility
・Tenants are responsible for the security of the property during their stay. All doors and windows
    must be locked when the property is unoccupied.

6.2 Damage or Loss
・Curacao Vacation Management is not responsible for any personal belongings that are lost, 
    stolen, or damaged during the stay.
・Tenants are encouraged to obtain travel insurance to cover potential losses / damages such
    as house keys, security cards, etc.

6.3 Indemnity 
・The Tenant agrees to indemnify and hold harmless Curacao Vacation Management, its 
    employees, and agents from any claims, damages, or expenses arising from the Tenants 
    use of the property. 


7. Termination of Rental Agreement

・Curacao Vacation Management reserves the right to terminate the rental agreement 
    immediately if the Tenant violates any terms of this agreement, engages in illegal activities, or
    causes harm to the property or neighborhood.
・In the event of termination, the Tenant will be required to vacate the property immediately,
    and no refund will be provided. 


8. Governing Law

・This Agreement is governed by the laws of Curacao. Any disputes arising from this Agreement
    will be resolved by the courts of Curacao. 


9. Privacy Policy

・Curacao Vacation Management respects your privacy. Personal information collected during
    the booking process will be used solely for processing reservations and will not be shraed with 
    third parties without your consent, except as required by law.

Car Rental

Rental Payment & Deductible:

​1. Rental Payment: 

The total rental fee must be paid on the day of vehicle delivery or by the following day, in cash (USD or ANG).

​

2. Deductible:

   - Standard deductible is $350 or ANG 630.

   - For drivers under 23 years of age, the deductible is $550 or ANG 1,000.

​

3. Deductible Waiver:

For an additional $15 or ANG 28 per day, the deductible can be waived.

 

Driver Terms:

​4. Primary Driver:

The individual who signs the rental agreement is considered the primary driver.

​

5. Additional Drivers:

An extra charge of $5 or ANG 9 per day applies per additional driver.

 

Fuel Policy:

​6. Fuel Level:

The fuel level at the time of rental is documented in the contract and should be returned with the same level. A charge of $15 or ANG 26 per 1/8 tank will apply if fuel levels differ at return.

 

Condition of Vehicle:

​7. Return Condition:

The vehicle should be returned in a condition reflective of normal use.

​

8. Cleaning Fee:

An excessive cleaning fee of $100 will apply if the vehicle requires deep cleaning.

​

9. Wet Items:

Avoid storing wet items or items exposed to salt water in the vehicle without proper protection.

​

10. Non-Smoking:

All vehicles are non-smoking.

 

Return Time:

11. Return Time:

Vehicles must be returned at the agreed time stated in the rental contract.

​

12. Late Return Option:

A late return (up to 5 PM) may be available for a flat fee of $23 or ANG 40 if arranged in advance.

​

13. Overdue Return Fee:

A charge of $30 per hour applies for any unauthorized late return.

 

Insurance, Costs, and Liability:

14. Comprehensive Coverage: 

    - This rental includes comprehensive insurance for lightning, storm damage, and accidents not caused

       by the renter.

    - A deductible of $350 or more applies in cases of:

            - Self-caused accidents, theft, vandalism, car racing, or off-road driving

            - Incidents involving hit-and-run damage

            - Vehicle damage, break-ins, or attempted break-ins, regardless of intent or negligence

15. Exclusions:

The renter is fully liable for repair and towing costs incurred from driving in areas like Watamula, San Juan, San Pedro, Boka Ascension, Christoffel, or Shete Boka National Park.

16. Tire and Glass:

The renter is responsible for any tire or glass damage during the rental period.

​

17. Personal Belongings:

Curacao Vacation Management is not liable for any personal items left in the vehicle.

​

18. Traffic Violations:

The renter is responsible for any fines resulting from parking or traffic violations.

​

19. Open Bed Passengers:

Passengers seated in an open cargo area are not covered by insurance.

​

20. Parking Security:

If possible, please park the vehicle overnight in a secure, lockable area.

 

Replacement Vehicle:

21. Curacao Vacation Management is not obligated to provide a replacement vehicle in the event of damage or if the vehicle becomes inoperable.

 

Lost/Damaged Items Charges:

   - Fuel cap: $20

   - Antenna: $40

   - Key: $200

   - Battery: $200

   - Radio: $200

   - Wheel wrench/jack: $30

 

Accident Protocol:

In the event of an accident, do not move the vehicle from the scene. Contact **Forensys** to file an official accident report. Insurance coverage is only valid if the accident is documented by Forensys.
